Who the Christmas Portrait terms cover
Christmas Portrait is operated by Lou Han, an independent developer based in China. The Christmas Portrait terms on this page govern the AI portrait service at christmasportrait.app. By using the site you accept these terms and our privacy policy. If you do not agree, please do not use the service.
The service is for adults aged 18 or older. Children must not use the site, upload photos or make purchases. You are responsible for the photos you upload and for how you use the portraits you make.
Photos you may upload
Upload only a photo of yourself, or of you and another adult who has agreed to have a portrait made. A photo may show one or two people. You must not upload:
- photos of anyone under 18, including family pictures where a child appears;
- photos of celebrities, public figures or any other person who has not agreed;
- photos you have no right to use, such as images copied from another person’s social media.
By uploading you confirm that you have this permission. We do not identify who is in a photo, and we do not create face templates or other biometric identifiers. Preview photos are not stored. For a paid set, the photo is kept encrypted only while the portraits are made and then deleted; a photo left before payment is kept for at most 72 hours.
What is not allowed
Under the Christmas Portrait terms, you may not use the service to create, or try to create:
- nudity, sexual or sexually suggestive images of anyone;
- hateful, harassing, threatening or degrading images;
- violent or gory images, including images that glorify violence or show injury, dismemberment or cruelty to people or animals;
- images that impersonate a real person, or deepfakes meant to deceive, defraud or embarrass someone;
- images suggesting that a real person endorses a product, cause or event;
- content that infringes trademarks, copyrights or anyone else’s rights.
You also may not resell access, automate requests, abuse the free previews or try to get around security limits. We may refuse a request, remove portraits or block access when these rules are broken. The six scenes are designed by us, and the model is instructed not to add text, logos or copyrighted characters.
Christmas Portrait terms for payment and delivery
Free previews are limited to two per device per day and are low resolution with a watermark. A paid set costs $4.99 for one photo and produces six portraits at 1792 × 2400 pixels without a watermark; the three-photo pack costs $9.99 for 18 portraits. Both are one-time payments with no subscription. Buyers in the euro area and the UK pay the same figures in euros or pounds.
Waffo Pancake is our merchant of record and handles checkout, payment processing and receipts. After payment, your portrait code is saved in your browser and emailed to you; keep it private. Portraits are made after payment, usually within a few minutes, and a private gallery link is emailed to you. The gallery stays available for 30 days, after which the portraits are deleted. Because portraits are digital content delivered right after payment, purchases are final and not refundable. The free remake process for failed or unlike portraits is described in the refund policy.
Using and sharing your portraits
You may download, keep, print and share your portraits for personal use, including on holiday cards, in messages and on social media. When you share them publicly, say that they were made with AI. Do not present a portrait as a real photograph in a way that could mislead someone, and do not share a portrait of the other person in a couple photo against their wishes.
Portraits are generated with Google’s Gemini image models on Google Cloud (Vertex AI). Google does not claim ownership of generated output, but AI images may not be unique or eligible for copyright protection, and similar images could be produced for other people. Anyone who has your gallery link can view your portraits, so share it only with people you trust.
AI results and our responsibility
AI output varies. We instruct the model to keep each face, skin tone, hairstyle, glasses and build as they appear in your photo, but we cannot promise a perfect likeness in every scene, so check the free preview before buying. The service is provided as is and as available. To the extent the law allows, we do not promise uninterrupted availability or fitness for a particular purpose, and we are not liable for indirect or consequential losses. Our total liability for any claim is limited to the amount you paid for the affected order. Nothing in the Christmas Portrait terms limits rights that cannot legally be excluded.
Report misuse
If you find a portrait that uses your photo without consent, shows a child, or breaks these terms in any other way, email hello@christmasportrait.app with “Report misuse” in the subject line. Include the gallery link and a short description of the problem. You do not need an account to report, and please do not attach extra personal information.
We review every report within two business days. While a report is under review, we may take the gallery link offline. If the content breaks these terms or someone’s rights, we delete it and may block further use, and we reply to the person who reported it with the outcome.
Intellectual property
You must not use the site to create or share content that infringes anyone else's intellectual property, such as their songs, lyrics, music, images, characters or trademarks, or to pass content off as made or endorsed by a real artist, creator or brand. If you do, we remove the content, may block your access, and handle any payment under our refund policy.
Governing law and changes
The Christmas Portrait terms are governed by the laws of China, except where mandatory consumer protection laws in your country give you rights that take priority. Please contact hello@christmasportrait.app first so we can try to resolve any concern before formal proceedings. We may update these terms for future use; this version was last updated on October 27, 2026.
